These General Terms of Use (hereinafter "GTU") aim to define the terms of access and use of the Sonova service, a collaboration platform allowing the sharing, management, and processing of audio projects created in DAW (Digital Audio Workstation) software, as well as their storage in the cloud (hereinafter the "Service").
Access and use of the Service are subject to prior and unconditional acceptance of these General Terms of Use. When creating their account, users are invited to read the GTU and accept them by checking a designated box. This box is not pre-checked. Acceptance of the GTU is evidenced by an electronic process allowing its proof to be retained, including the date and time of acceptance. Any use of the Service subsequent to this acceptance constitutes recognition of the validity of these GTU.

2. Service Presentation
Sonova is an online service notably allowing:
- Deposit of audio projects and associated files (DAW sessions, stems, presets, etc.)
- Real-time or asynchronous collaboration between multiple users
- Storage, synchronization, and version management of projects in the cloud
- Communication features (comments, temporal annotations, etc.)
- Role and permission management on projects
The Service is subject to change at any time, particularly to improve its features.
3. Access to Service
3.1 Account Creation
Access to the Service requires the creation of a user account. The user undertakes to provide accurate, complete, and up-to-date information.
3.2 Credentials Confidentiality
Login credentials are strictly personal and confidential. Any action performed via the user account is deemed to have been performed by the user.
3.3 Service Availability
Sonova implements reasonable means to ensure accessibility of the Service, without guarantee of continuous availability, particularly in case of maintenance, updates, or technical constraints.
4. Use of Service
4.1 Compliance with Regulations
The user undertakes to use the Service in accordance with applicable laws and regulations. It is notably prohibited to:
- Infringe on third-party rights
- Disseminate illegal content or content contrary to public order
- Violate intellectual property rights
4.2 Prohibited Behaviors
Strictly prohibited are:
- Any attempt to intrude, bypass, or compromise the Service
- Exploitation of technical vulnerabilities
- Abusive or excessive use likely to harm the platform's operation
- Sharing offensive, discriminatory, or inappropriate content
4.3 Fair Use
Sonova reserves the right to limit, suspend, or restrict certain features in case of abusive or excessive use of the Service.
5. Content and Intellectual Property
5.1 Content Ownership
The user retains full intellectual property rights over the content they import, create, or share via the Service.
5.2 License Granted to Sonova
To ensure the operation of the Service, the user grants Sonova a license:
- Non-exclusive
- Worldwide
- Free of charge
- Limited to the duration of Service use
This license allows hosting, backup, technical processing, and generation of temporary copies necessary for the platform's operation.
5.3 Sharing Content
The user is solely responsible for the rights they grant to collaborators with whom they share their content.

6. Personal Data – GDPR
The controller of personal data processing is the Sonova project leader, acting as the Service publisher.
Data processing is based on contract execution, compliance with legal obligations, and the legitimate interest of the Service.
6.1 Data Collected

- Technical data (logs, IP addresses, connection data)
- Content deposited on the Service
6.2 Purposes of Processing

- Provide and improve the Service

7. Storage and Security
Sonova implements appropriate technical and organizational measures to protect data stored on the Service (encryption, backups, access controls), without guaranteeing absolute security.
8. Subscriptions and Billing
8.1 Paid Offers
Certain features of the Service may be accessible via paid subscriptions. Pricing conditions, duration, renewal, and termination terms will be specified upon subscription.
8.2 Right of Withdrawal
In accordance with applicable law, certain digital offers may be excluded from the right of withdrawal. Applicable conditions will be specified at the time of order.
9. Liability
9.1 User Liability
The user is solely responsible for:
- Content they import or share
- Rights attached to used works
- Consequences of sharing with third parties
9.2 Sonova Liability
Sonova cannot be held liable for:
- Indirect damages or economic losses
- Service interruptions due to a third party, force majeure, or technical constraints
- Behavior or content published by users
10. Force Majeure
Sonova cannot be held liable for non-performance of its obligations in case of force majeure as defined by French jurisprudence.
11. Termination and Account Deletion
11.1 Termination by Sonova
Sonova reserves the right to suspend or delete a user account in case of:
- Non-compliance with these GTU
- Abusive or fraudulent use of the Service
- Security or legal compliance reasons
11.2 Termination by User
The user can request account deletion at any time via the contact form.
11.3 Data Fate
In case of account deletion:
- Data may be recovered for a duration of 2 months
- After this period, they will be permanently deleted, unless legal obligation requires otherwise
12. Modification of GTU
Sonova reserves the right to modify these GTU.
The user will be informed of any substantial modification.
Use of the Service after modification constitutes acceptance of the new GTU.
13. Language
These GTU are drafted in French.
In case of translation, only the French version is authoritative.
14. Applicable Law and Jurisdiction
Failing amicable resolution, any dispute regarding the interpretation or execution of these GTU will be submitted to the competent courts of Sonova's headquarters.
This jurisdiction attribution applies subject to mandatory legal provisions applicable to consumers.
